Penalty on discovery c.f.Sec.20 of Opium Ord. 23 of 1909 as amended by Sec.3(g) of Opium Asend Ord.1913.

(a) of raw opium illegal

In the old Ordinances the penalty was a maximum fine of 2,000 dollars or a maximum imprisonment of 12 Lonths for every chest of opium illeg- -ally imported or found missing.

In the Straits Settle- -ments the penalty is

i a maximum fine of

1,000 dollars or a sum not exceeding 10 times the market value of the opium in question, or in- -prisonment for a maximum period of 6 months or to both such punishments and an increase in the case of a second conviction.The local penalty is fixed at a Laxim fine of 2,000 dollars or 10 times the market value whichever may be the greater of the opium illegally imported or missing and to a maximum imprisonment of 12 months. This system of Living the Tribunal, before

which an offender is tried, the power of fixing a pecuniary penalty over the Laximum in the event of 10 times the value of the opium concern-

ed in the charge exceeding the maximu fine is taken from the principle similar. -ly adopted in the Straits Settlements.

This offence is punishable under Sec. 61 of the Ordinance.
